We believe that there are effective ways to increase the relevance of advertising messages by using non-personal information. When Placecast has the opportunity to deliver an ad to you through a third party service, site or application, we may receive information about your device and location from third party ad exchanges and/or publishers. This information does not enable us to personally identify you but may include the unique anonymous identifier associated with your device, your device’s IP address, browser type, carrier, device model and operating system, the location of your device at the time the advertisement was served, the application or web page viewed on your mobile device and/or the date and time at which those were viewed, as well as your interactions with advertising content. We utilize this non-personal information to improve the relevance of advertisements published on your device as we believe that more relevant advertising is more useful to you, in addition to being more effective for advertisers. Any such information is received in accordance with the third party application or website’s privacy policies and subject to their terms and conditions. We do not use the information they provide to us for any purpose other than serving you with interest-based ads on behalf of our partners and advertisers.

When we provide direct marketing services on behalf of our partners, these services require the collection of personal information with your affirmative consent. The types of personal information collected may include mobile numbers, email address, as well as device IP address and location which are not in themselves "personal information" but may be deemed as such when combined with personal information.

We will include an opt-out link or reply address in each e-mail or text message that we send. After unsubscribing, you will be removed from our database. Please allow up to 5 business days to process your request.

8. GOVERNING LAW
Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.
Jurisdiction. You agree that any action at law or in equity arising out of or relating to this Agreement or any Placecast services shall be filed only in the state or federal courts in and for San Francisco County, California and you hereby consent and submit exclusively to the personal jurisdiction of such courts for the purposes of litigating any such action. Either Placecast or you may demand that any dispute or claim between the Placecast and you must be settled by arbitration utilizing the dispute resolution procedures of the American Arbitration Association ("AAA") in San Francisco, California, USA and, if so demanded by Placecast or you, both parties hereby acknowledge and agree to submit exclusively to the jurisdiction of the AAA in San Francisco, CA to resolve the applicable dispute or claim; provided that the foregoing shall not prevent either party from seeking injunctive relief in a court of competent jurisdiction.
